My understanding is that you'd need publications roughly = in word count to a standard phd, plus commentary, and you need to demonstrate a sustained and original contribution. So more like 5 pubs I think.

Before getting the Courts involved, have a look at http://www.oiahe.org.uk/ not sure how good they are but the Courts would normally have wanted you to consider all other avenues first.

With your current MA and not need the MPhil, if you have some experience in the area / your marks are good enough. 3 years isn't that long to be away from academia.

No, it doesn't work like that, sorry. If you did an MPhil you would then need to apply for a PhD. You might be able to find a 1+3 (masters leading on to a PhD) but that'll still take 4 years. You could apply for a PhD...

No idea, but both unis have a great reputation. NY is a great city of course, don't know much about Boston. MAYBE NY would stand out a bit more because everyone knows about it?

How to respond to a very negative reviewer?

It is completely improper for a reviewer to respond in that way, but do keep calm in replying. I thought that if two reviewers were entirely opposed, a 3rd reviewer would be needed? I'd contact the editor.

When can you legitimately use the title Dr?

I thought that the PhD (and so the Dr) wasn't officially conferred until graduation? But as stated, anyone in the academe world will know the score. So I think go with Mr/Ms whatever.
